The following are the Terms and Conditions of orders placed with FoneFunShop

On ordering from FoneFunShop you confirm your agreement to these Terms and Conditions.

All images on this site are reproduced with a view to portraying our products as accurately as possible. Please be aware that designs may vary slightly, from those shown, due to normal design and production fluctuations.

 


 

Buying Products on Our Website

All of our prices displayed are exclusive of VAT. 
VAT and Delivery charges will be calculated during the checkout process, after you choose your preferred delivery method and country. 
Orders shipping outside the UK may be subject to extra local import tax/duty/vat charges payable by the buyer before the items can be delivered, these charges are not included in the price on our online store. 

We try to have accurate pricing and availability information on all the products we offer; despite our best efforts, a small number of the products in our catalogue may be mis-priced or have inaccurate stock availability information. We do verify prices as part of our acceptance procedure, and will inform you if a products correct price is higher than that stated in your order, so you may ultimately decide whether or not to order the product at the correct price.

We may change the price of any product at any time before you place an order. If the goods you have ordered are not in stock, we may send an e-mail to inform you, at which time you may decide to wait a little longer or decide to cancel your order. We do our best to accurately estimate when items will be despatched and/or delivered; however, these estimates are based on several factors over which we have no control and as such, time for despatch and/or delivery shall not be of the essence of the contract and should be considered as rough estimates only.

We reserve the right to substitute a product within an order when the product has been discontinued or has been out of stock for an extended period of time. Any substitute products added to an order may differ slightly in appearance, but will be of equal or greater specification and monitory value, with no additional charge added for this addition.
 

Reason why delivery costs may change:
We reserve the right to review shipping costs for large orders prior to dispatch. In the instance where the fixed delivery cost displayed within the checkout are not sufficient to ship your order. We will you contact you as soon as possible to ensure the speedy delivery of your item.

 


 

Notes:

UK Orders:

All transactions within the UK will be subject to UK VAT.

By placing an order from non-EU territories (e.g. Jersey & Guernsey – VAT-free zones are outside of normal UK and CE trade tariffs) you agree to accept the VAT levied against your purchase.

 

EU Orders: Updated 01-01-2021

As of January 1st 2021 All orders shipping to the EU will be automatically exclusive of VAT.

However, your order will be subject to extra local VAT charges payable by the buyer before the items can be delivered, these charges are not included in the price on our online store.

Please Note: The UK/EU trade deal means that EU customers will not have to pay import duty (tariffs) on goods ordered from the UK, only vat is chargeable on delivery.

 

Outside EU Orders (Rest of World):

Orders placed from and shipping to a country outside the EU will be automatically exclusive of VAT, however please note that a customs charge would normally be payable upon receipt.

 

 

Security Checks

FoneFunShop Ltd. reserves the right to carry out security checks on a random selection of orders each day. Whilst in most cases this should not effect the despatch of an order, we must advise that security checks require the Customer Relations team to contact the customer, and should we not be able to reach you, your order may be delayed.

 


 

Accepted Methods of Payment

 

There are two primary methods of payment for goods ordered:-

2. Payment after placing order online

If you do not wish to pay online, simply add the items the wish to purchase to cart, then follow the instructions given. You can then make payment using one of the offline payment methods below.

Pay by Telephone Ordering
Telephone Order If you prefer to pay by telephone using your credit or debit card, please select this option, details on how to pay will be displayed along with details of your order once your delivery address as been confirmed
Pay by Direct Bank Deposit / Transfer
Bank Transfer To pay via Direct Bank Transfer or Bank Deposit, please select this option, details on how to pay will be displayed along with details of your order once your delivery address as been confirmed
Pay by Purchase Order
Purchase Order To pay via Purchase order you must first contact us to be approved to pay by this method. Once approved, email a copy of the PO to us and also enter the PO number when placing the order online.

 


 

Delivery

NOTE For EU Customers - As of January 1st 2021 All orders shipping to the EU will be automatically exclusive of VAT.  However, your order will be subject to extra local VAT charges payable by the buyer before the items can be delivered, these charges are not included in the price on our online store. Please Note: The UK/EU trade deal means that EU customers will not have to pay import duty (tariffs) on goods manufactured in the  UK, only vat is chargeable on delivery. 

Orders received before 3.00pm Monday-Friday (except UK public holidays) are usually dispatched the same day subject to stock availability.

* Although 1st Class Delivery can take between 1 – 3 working days from the dispatch date, it’s been our experience that the majority of late packages arrive just a day or two after this estimated delivery period. Please be aware however that although NOT the norm, delays on this service can result in orders taking up to 15 days to arrive.


† Except Scottish Highlands, Scottish Islands, Northern Ireland, Channel Islands which normally take 2 working days

Note:

1. The estimated arrival times are taken directly from information provided by our couriers. These are estimates only, FoneFunShop are not responsible if this varies.

2. All deliveries will require a signature on receipt, apart from those delivered using the Royal Mail Standard 1st Class service (UK). However, where the value of your total order exceeds £75 or/and includes an high value item -such as an unlocking box – then your delivery option will be automatically upgraded to a ‘Royal Mail Special Next Working Day ’ service.

3. In exceptional circumstances we reserve the right to use alternative couriers.

4. Saturday deliveries are at the discretion of the couriers, it is our experience that in most cases they do choose to deliver to residential addresses on Saturday mornings.

5. When signing for a delivery you are accepting the item in the condition it arrives. Please ensure you check your item before signing for it, as we cannot be held responsible for the condition of an item once it has been signed for and accepted.

6. If goods are returned to FoneFunShop because of a failed delivery for any reason, the carriage cost is not refundable. We reserve the right to charge for any extra carriage costs incurred to re-send goods.

7. Missing or delayed items: Please note that we will need to wait 15 days before being able to trace, replace or refund lost items.

Order Tracking

Following your purchase online, FoneFunShop will send you email confirmation to acknowledge your order and again when your goods have been dispatched containing your tracking info.  The email address used, will be the one you provided at the point of purchase.

Delayed/Lost Delivery

  1. If you have not received your order within 15 working days of despatch (not including Sundays), you must immediately advise FoneFunShop Customer Services of the delay/loss. FoneFunShop will investigate why you have not received your goods and advise you directly.
  2. Where a re-shipment of the order is requested, this will only be issued after the 15 working days maximum delivery time has passed.
  3. Where a refund is requested, the refund will only be issued after the 15 working days maximum delivery time has passed.

 


 

Security

Orders placed online can be placed on our online cart system. 

Payments placed online will be placed on Barclaycard Merchant Services Secure Server, or Paypal

On these payment portals, all credit / debit card details are transmitted using SSL, the universally recognized security system for transmitting encrypted information over the Internet. Submitted details are processed directly by Barclaycard Merchant Services or Paypal. FoneFunShop never actually see your credit / debit card details. or Paypal credentials

Please note that Internet host IP addresses are recorded for security reasons when placing an order online.

 


 

Privacy Statement

At FoneFunShop we take customer privacy and data protection seriously.

We implement all necessary measures to be compliant with General Data Protection Regulation (GDPR), and are registered with the UK Government Information Commissioner’s Office (ICO).  Our Registration Number is: ZA328931

We take all reasonable care to ensure that any details that you submit to us are kept secure. The details that you submit to us will be kept to process orders only.

FoneFunShop will not knowingly pass on any details we hold on customers or web site visitors to any third parties. We protect the privacy of this personal information using our highly secure, password-protected servers.

We may use the email addresses submitted to us to contact you to offer technical support for products purchased from us if requested.  And to pass your tracking number for orders you placed, or to deliver digital goods orders.

We do monitor customer traffic patterns and site usage to help us develop the design and layout of the fonefunshop web site.

 

 

1. WHAT DO WE DO WITH YOUR INFORMATION?

FoneFunShop Ltd. will be what’s known as the “Controller” of the personal data you provide to us.

When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address.

When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system.

Email marketing (if axpplicable): With your permission, we may send you emails about our store, new products and other updates.

When you provide us with personal information to create an account, place an order, arrange for a delivery or return a purchase, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

If after you opt-in, you change your mind, you may withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information, at anytime, on your account page by using our contact us form or by contacting us at sales@fonefunshop.com.

 

3. DISCLOSURE

We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service.

 

4. PAYMENTS

We use a third party payment processor(s) to process payments made to us. In connection with the processing of such payments, we do not retain any personally identifiable information or any financial information such as credit card numbers. 

 

5. THIRD-PARTY SERVICES

In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website’s Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements.

 

6. SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.

All the personal data we process is processed by our staff in the United Kingdom however for the purposes of IT hosting and maintenance this information is located on servers within the Netherlands on a secure server behind a firewall. No 3rd parties have access to your personal data unless the law allows them to do so.

We have a Data Protection regime in place to oversee the effective and secure processing of your personal data.

 

Cookies

How we use cookies on our site and what information we collect
In our shopping cart and online ordering, cookies are built into the software for the purpose of maintaining cart contents, registrations and collection of generic data.

We also use website analysis software. This information helps us understand customer interests and helps us improve our website. A cookie is used to store small amounts of information. The cookie does not contain personal details. We do not sell, give, or trade the statistics they store to any 3rd parties for data-mining or marketing purposes.

xid - unique token, sessional.

recent_login - stores your username to auto-complete the sign-in form next time you visit the store. Persistent for 3 days by default (can be changed by store’s admin).

viewedResources - holds a list of cached CSS files, this is used to make store’s pages loading faster. Persistent for 1 hour.

rv - holds a list of products you recently viewed in the store. Does not expire.

xc_np_product_#### - holds product identifiers, used to navigate within store’s catalog. Persistent for 30 minutes

Disabling/Enabling Cookies
You have the ability to accept or decline cookies by modifying the settings in your browser. However, you may not be able to use all the interactive features of our site if cookies are disabled.

Your Right to Cancel

You can cancel your contract with FoneFunShop Ltd. within 14 working days of delivery (starting the day after the receipt of the goods), as per the guidance set out in the Consumer Rights Act 2015

Orders for Personalised items or "to the buyers specification" cannot be cancelled , this includes, credits, activations, unlock codes, iPhone unlocks whereby the buyers IMEI number is considered unique to the order and has no resale value. (see returns policy below for more info)

You should inform FoneFunShop Ltd. in writing, either by post or by using the contact form of any cancellation request.

If your order is in transit or you have already taken receipt of it, then to cancel this contract you must use the FoneFunShop Returns Form (available to download from our returns page) and return the unwanted item(s) together with your order number. The items are subject to our Returns Policy detailed below.

All items returned from countries outside of the EU must be clearly labeled as ‘Returned Item’.

 


 

Returns Policy

At FoneFunShop Ltd. we have every confidence that you will be delighted with your purchase. However, in the event that you wish to return any goods purchased, then please follow the applicable policy detailed below.

 

Unwanted Goods - within 30 Days

You (the buyer) pay for return shipping fees.

You should inform FoneFunShop Ltd. in writing, within 30 days of receiving your item(s) either by post or by using the contact form of any return request.

You can return unwanted items within 30 calendar days of delivery and we will refund you the price paid for the items. In addition to the refund on your items; if your return request is received within 30 days of delivery, and items received within the following 30 days, then we will refund the cheapest standard delivery option to you unless there is another item on your order. Outside of 30 days from receipt, refunds for non-faulty returned items will not include the original delivery charge or the cost of delivering the items to us.

If you return a product to us that is not received in a brand new condition we reserve the right to return the product to you or issue a partial refund with a deduction because the item is not fit for resale.  You should only handle the item as if you were in a high street store viewing the item as you normally would. it should not be opened or used.

 

Returns Exclusions (Unwanted Goods)

Unfortunately, we cannot refund or cancel Personalised Orders or Orders Made To The Buyers Specification
Orders containing personalised items or to the buyer's specification cannot be canceled, this includes unlock codes and iPhone unlocks. whereby the buyers IMEI number is considered unique to the order and has no resale value. 
Unlock codes and iPhone unlock services are based on the unique IMEI number of the customer's phone and are considered as a "made to a consumers specification" order.
These orders cannot be canceled as they have no resale value.  For example, an unlock code for John's phone would not work on Jane's phone, because the 2 phones have different IMEI numbers. the code would simply fail on all other phones except johns.  We have to order and pay for these codes from our suppliers for the customer once they place their orders online and supply their unique IMEI number, the codes are no good for anyone else so they cannot be resold to a different customer.

 


 

Faulty Goods - within 30 Days

If your goods are faulty on arrival, you have 30 calendar days from receipt, in which to inform us of the fault in order to claim a full refund or exchange or repair exchange, (please note that for our business customers, different terms of sale apply), after 30 days your return will be processed under the terms of the Manufacturers’ Warranty (See below).

Goods should be returned in their original packaging complete with all accessories and documentation. Once we have verified the fault, we will conduct a repair, or issue a replacement, or full refund to you via your original payment method. We test returned items, and if our technicians find a returned item is not faulty or has been tampered with, we will return the item to you ( In certain circumstances, faults will need to be diagnosed by the manufacturers of the item before a replacement can be issued – i.e. memory card reading faults, item not powering up, etc.). In this instance, you will be liable for the return carriage.

Goods outside 30 calendar days shall be issued with a replacement or repair only depending on the warranty length of the product.

If a refund is required, Refunds for faulty goods will be issued back to the original payment method.

If your order was only for one item and this item has been returned then the refund cost you paid to receive this order will also be refunded.

If your order contained multiple items and you are not returning all of them, then the cost of shipping your order to you will not be refunded.

Any returns should be marked as "Returned Faulty Item" on the parcel or jiffy bag etc.

Returns Exclusions (faulty goods)

Unlocking box's and Dongles that are registered by the buyer and becomes faulty we will offer to replace or repair it depending on the warranty length of the product.

Unfortunately, we cannot refund any unlocking box or dongle that has been used to unlock the phone, we contact the manufacturer of the tool returned to check this prior to refunding or canceling. However if faulty we can offer to replace or repair it depending on the warranty length of the product.

Unfortunately, we cannot refund or cancel Personalised Orders or Orders Made To The Buyers Specification

Replacements & Refunds

Where applicable, replacement or alternative items will be processed as promptly as possible, but please be aware that it may take up to 10 working days to issue the item. If an item is out of stock, it will then become a priority back order to be shipped once stock is available.

If you are eligible for a refund, we will refund you back to the payment method you used when you originally paid for your order. Please note: It is your responsibility to notify us of any changes to your card details i.e. you no longer have that account. Refunds can take up to 30 days to process. Refunds by credit card are made to the same credit card that was used for the original purchase*.  Refunds by Paypal will be refunded back to the original Paypal payment account.*

Any return that is not accompanied with the returns form or returns reference number will be held by FoneFunShop for 30 days, awaiting the return of the completed form. Items that have not been reclaimed by you within this period will be disposed of after this time and will result in the return being completed without action.

*These terms do not affect your statutory rights.

 


 

Warranty

Where a product develops a fault, a repair or replacement will be offered, as long as the item is within its manufacture warranty timescale.

Where a product develops a fault outside its manufacture warranty timescale, we will try to help by offering a chargeable repair if possible, or if not possible you would need to purchase the replacement item at the current value.

 


 

Fraud

FoneFunShop Ltd. will not tolerate any attempts to obtain goods by fraudulent means. Any fraudulent action will be reported to the relevant authorities.

Please note that Internet host IP addresses are recorded when placing an order online.

 


 

Disclaimer

All trademarks mentioned on this site are the property of their respective companies. Including product names, logos, commercial symbols, trade names, and slogans are trademarks of those respective or related companies and are protected by international trademark laws, and they are used here only for information purpose.

Please be aware that using unofficial products with your mobile phone may invalidate your phone's manufacturer's Warranty. FoneFunShop Ltd is not responsible for any damage caused to your phone.

Unlocking is legal in most countries, customers receiving any unlocking equipment or services are required to check local laws before purchasing.  FoneFunShop Ltd. is not responsible for any law infringements made by its customers.

Barred phones: Fonefunshop do not unbar phones that are reported lost/stolen.  All unlocking services and equipment unlock the phones, but if the phone is barred you need to contact your operator to find out why, as this is can only be rectified by your service provider.

Any work carried out by third-party service software is done at your own risk.  FoneFunShop Ltd. is in no way responsible for damage caused by using third party software solutions.
